国务院办公厅关于加快推进社会信用体系建设构建以信用为基础的新型监管机制的指导意见

各省、自(zi)治区、直(zhi)辖市(shi)人民政(zheng)府,国务(wu)院各部委、各直(zhi)属机构:

  为加强社会信用(yong)体(ti)系建设,深入推进(jin)“放管(guan)服”改革,进(jin)一步发(fa)挥信用(yong)在(zai)创新监管(guan)机制、提(ti)高(gao)监管(guan)能力(li)和水平方面的基础性作用(yong),更(geng)好激(ji)发(fa)市场主体(ti)活力(li),推动高(gao)质量发(fa)展,经国务院同意,现提(ti)出如下意见。

  一、总体要求

  以习近平新(xin)时代中(zhong)国特色(se)社会主义(yi)思(si)想为(wei)指(zhi)导,深入贯彻落实党的十九大和十九届二中(zhong)、三中(zhong)全(quan)会精神(shen),按(an)照依(yi)法依(yi)规、改革创新(xin)、协同共(gong)治的基本原则,以加强信(xin)用(yong)监(jian)(jian)管为(wei)着力点,创新(xin)监(jian)(jian)管理念、监(jian)(jian)管制(zhi)度和监(jian)(jian)管方式(shi),建立健全(quan)贯穿市(shi)场主体(ti)全(quan)生命周期,衔接事前、事中(zhong)、事后(hou)全(quan)监(jian)(jian)管环节的新(xin)型监(jian)(jian)管机(ji)制(zhi),不(bu)断提升监(jian)(jian)管能(neng)力和水(shui)平,进一(yi)步(bu)规范(fan)市(shi)场秩序,优(you)化营商环境,推(tui)动高质量发展(zhan)。

  二、创(chuang)新(xin)事前(qian)环节信用监管

  (一)建立健全(quan)信(xin)用(yong)(yong)(yong)承诺(nuo)(nuo)(nuo)(nuo)制度。在办理(li)(li)适用(yong)(yong)(yong)信(xin)用(yong)(yong)(yong)承诺(nuo)(nuo)(nuo)(nuo)制的(de)行(xing)(xing)政许(xu)可(ke)事项时,申(shen)请人承诺(nuo)(nuo)(nuo)(nuo)符(fu)合(he)审批条件并(bing)提交有关材料的(de),应予即时办理(li)(li)。申(shen)请人信(xin)用(yong)(yong)(yong)状(zhuang)况较好、部(bu)分(fen)申(shen)报材料不齐备(bei)但书(shu)面承诺(nuo)(nuo)(nuo)(nuo)在规定期(qi)限内提供(gong)的(de),应先行(xing)(xing)受理(li)(li),加快办理(li)(li)进度。书(shu)面承诺(nuo)(nuo)(nuo)(nuo)履(lv)(lv)约(yue)情(qing)(qing)况记(ji)入信(xin)用(yong)(yong)(yong)记(ji)录,作为事中(zhong)、事后监管的(de)重要依(yi)据,对不履(lv)(lv)约(yue)的(de)申(shen)请人,视情(qing)(qing)节实施惩戒。要加快梳理(li)(li)可(ke)开(kai)(kai)展信(xin)用(yong)(yong)(yong)承诺(nuo)(nuo)(nuo)(nuo)的(de)行(xing)(xing)政许(xu)可(ke)事项,制定格(ge)式规范(fan)的(de)信(xin)用(yong)(yong)(yong)承诺(nuo)(nuo)(nuo)(nuo)书(shu),并(bing)依(yi)托各(ge)(ge)级信(xin)用(yong)(yong)(yong)门(men)户网站(zhan)向社(she)会(hui)公开(kai)(kai)。鼓励(li)市(shi)场主(zhu)体主(zhu)动向社(she)会(hui)作出信(xin)用(yong)(yong)(yong)承诺(nuo)(nuo)(nuo)(nuo)。支持行(xing)(xing)业(ye)协会(hui)商(shang)会(hui)建立健全(quan)行(xing)(xing)业(ye)内信(xin)用(yong)(yong)(yong)承诺(nuo)(nuo)(nuo)(nuo)制度,加强行(xing)(xing)业(ye)自律。(各(ge)(ge)地区各(ge)(ge)部(bu)门(men)按职责(ze)分(fen)别负(fu)责(ze))

  (二)探(tan)索开展(zhan)经(jing)营者准(zhun)入前诚(cheng)信(xin)(xin)教育。充分利用各(ge)(ge)级各(ge)(ge)类政务服(fu)务窗口,广泛开展(zhan)市场主体守法诚(cheng)信(xin)(xin)教育。为市场主体办(ban)理注册、审批、备案等相关(guan)业(ye)务时,适时开展(zhan)标准(zhun)化(hua)、规(gui)范(fan)化(hua)、便捷化(hua)的(de)(de)法律知识(shi)和信(xin)(xin)用知识(shi)教育,提高(gao)经(jing)营者依法诚(cheng)信(xin)(xin)经(jing)营意(yi)识(shi)。开展(zhan)诚(cheng)信(xin)(xin)教育不(bu)得收费,也不(bu)得作为市场准(zhun)入的(de)(de)必(bi)要条件。(各(ge)(ge)地(di)区(qu)各(ge)(ge)部门(men)按职(zhi)责(ze)分别(bie)负责(ze))

  (三)积(ji)极拓展信(xin)用(yong)(yong)报(bao)告(gao)应用(yong)(yong)。鼓(gu)励各类市场(chang)主体在生产经营活(huo)动中更广泛、主动地(di)(di)应用(yong)(yong)信(xin)用(yong)(yong)报(bao)告(gao)。在政府采购、招标投标、行(xing)政审(shen)(shen)批、市场(chang)准(zhun)入、资质审(shen)(shen)核等事(shi)项中,充(chong)分(fen)发挥公共信(xin)用(yong)(yong)服务机(ji)构(gou)和第三方(fang)信(xin)用(yong)(yong)服务机(ji)构(gou)出(chu)具的信(xin)用(yong)(yong)报(bao)告(gao)作用(yong)(yong)。探索(suo)建立(li)全国(guo)统一的信(xin)用(yong)(yong)报(bao)告(gao)标准(zhun),推动信(xin)用(yong)(yong)报(bao)告(gao)结果实现(xian)异地(di)(di)互认(ren)。(发展改革委、人民银行(xing)牵头(tou),各地(di)(di)区各部(bu)门按(an)职责(ze)分(fen)别负责(ze))

  三(san)、加强事中(zhong)环(huan)节信用监管

  (四)全面建(jian)立市(shi)(shi)场主体(ti)信(xin)用(yong)记(ji)录(lu)。根据权(quan)(quan)责(ze)清单建(jian)立信(xin)用(yong)信(xin)息(xi)采(cai)集目录(lu),在办(ban)理注(zhu)册登记(ji)、资(zi)质审核、日常监管、公共(gong)服务等过(guo)程中(zhong),及(ji)时、准(zhun)确(que)、全面记(ji)录(lu)市(shi)(shi)场主体(ti)信(xin)用(yong)行为(wei),特(te)别是将失信(xin)记(ji)录(lu)建(jian)档留痕,做到可(ke)(ke)查(cha)可(ke)(ke)核可(ke)(ke)溯。(各地区(qu)各部(bu)门按职责(ze)分别负责(ze))完善法(fa)(fa)人和(he)非法(fa)(fa)人组织统一社(she)会(hui)(hui)信(xin)用(yong)代码(ma)制度,以(yi)统一社(she)会(hui)(hui)信(xin)用(yong)代码(ma)为(wei)标识,整(zheng)合(he)(he)形成完整(zheng)的市(shi)(shi)场主体(ti)信(xin)用(yong)记(ji)录(lu),并通过(guo)“信(xin)用(yong)中(zhong)国(guo)”网(wang)(wang)站、国(guo)家企业信(xin)用(yong)信(xin)息(xi)公示系统或中(zhong)国(guo)政(zheng)府(fu)网(wang)(wang)及(ji)相(xiang)关部(bu)门门户网(wang)(wang)站等渠道依法(fa)(fa)依规向社(she)会(hui)(hui)公开(kai)。完成12315市(shi)(shi)场监管投诉(su)举(ju)报热线和(he)信(xin)息(xi)化平台整(zheng)合(he)(he)工(gong)作,大力开(kai)展消费投诉(su)公示,促进经营者落实消费维权(quan)(quan)主体(ti)责(ze)任(ren)。(发展改革委、市(shi)(shi)场监管总(zong)局负责(ze))

  (五(wu))建立(li)健(jian)全信用信息自愿(yuan)注册(ce)机制。鼓(gu)励市场(chang)主体在(zai)“信用中国(guo)”网(wang)站或其他渠道上自愿(yuan)注册(ce)资质证照、市场(chang)经营、合(he)同履约、社会公(gong)益等信用信息,并对(dui)信息真实性(xing)公(gong)开(kai)作出(chu)信用承诺(nuo),授权网(wang)站对(dui)相关信息进行整合(he)、共享与应(ying)用。经验证的自愿(yuan)注册(ce)信息可作为(wei)开(kai)展(zhan)(zhan)信用评价和生成信用报(bao)告的重(zhong)要(yao)依据(ju)。(发展(zhan)(zhan)改(gai)革委牵头,各部门按职责分别(bie)负责)

  (六)深入开展(zhan)公共(gong)信(xin)(xin)用(yong)综合(he)评价(jia)。全国信(xin)(xin)用(yong)信(xin)(xin)息共(gong)享平台要加(jia)强(qiang)与(yu)相关(guan)部(bu)门的协同配合(he),依(yi)(yi)(yi)法依(yi)(yi)(yi)规整(zheng)合(he)各类信(xin)(xin)用(yong)信(xin)(xin)息,对市场主体开展(zhan)全覆盖、标准化、公益性的公共(gong)信(xin)(xin)用(yong)综合(he)评价(jia),定(ding)期将(jiang)评价(jia)结果推送至(zhi)相关(guan)政府部(bu)门、金(jin)融机构、行业协会(hui)商会(hui)参(can)考使用(yong),并依(yi)(yi)(yi)照有关(guan)规定(ding)向社会(hui)公开。推动相关(guan)部(bu)门利用(yong)公共(gong)信(xin)(xin)用(yong)综合(he)评价(jia)结果,结合(he)部(bu)门行业管理数(shu)据,建立行业信(xin)(xin)用(yong)评价(jia)模(mo)型,为信(xin)(xin)用(yong)监管提(ti)供(gong)更精准的依(yi)(yi)(yi)据。(发(fa)展(zhan)改革委牵(qian)头,各部(bu)门按职(zhi)责分别负责)

  (七)大力推进(jin)信(xin)用(yong)(yong)分(fen)(fen)(fen)级(ji)分(fen)(fen)(fen)类监管。在充分(fen)(fen)(fen)掌握信(xin)用(yong)(yong)信(xin)息、综合研判信(xin)用(yong)(yong)状况的(de)(de)基础上(shang),以公共信(xin)用(yong)(yong)综合评价结(jie)果、行(xing)业信(xin)用(yong)(yong)评价结(jie)果等为依据(ju),对(dui)监管对(dui)象进(jin)行(xing)分(fen)(fen)(fen)级(ji)分(fen)(fen)(fen)类,根(gen)据(ju)信(xin)用(yong)(yong)等级(ji)高(gao)低采取差异(yi)化的(de)(de)监管措施。“双随机、一公开(kai)”监管要与信(xin)用(yong)(yong)等级(ji)相结(jie)合,对(dui)信(xin)用(yong)(yong)较(jiao)好、风(feng)险(xian)较(jiao)低的(de)(de)市场主(zhu)体,可合理降低抽查比例和(he)频(pin)次,减少对(dui)正常(chang)(chang)生产经营(ying)的(de)(de)影响;对(dui)信(xin)用(yong)(yong)风(feng)险(xian)一般的(de)(de)市场主(zhu)体,按(an)常(chang)(chang)规(gui)比例和(he)频(pin)次抽查;对(dui)违法(fa)失信(xin)、风(feng)险(xian)较(jiao)高(gao)的(de)(de)市场主(zhu)体,适当提高(gao)抽查比例和(he)频(pin)次,依法(fa)依规(gui)实行(xing)严管和(he)惩戒。(各地区各部门(men)按(an)职责分(fen)(fen)(fen)别负责)

  四、完(wan)善事后(hou)环节信用监管

  (八)健全(quan)失信(xin)(xin)联合惩(cheng)戒对(dui)(dui)象(xiang)认(ren)定机制。有关(guan)部门(men)依(yi)据(ju)在事前、事中监管环节(jie)获取并认(ren)定的(de)(de)(de)失信(xin)(xin)记(ji)录,依(yi)法(fa)依(yi)规建立健全(quan)失信(xin)(xin)联合惩(cheng)戒对(dui)(dui)象(xiang)名(ming)单(dan)制度。以相关(guan)司(si)法(fa)裁判、行(xing)政处(chu)罚、行(xing)政强制等处(chu)理结果为(wei)依(yi)据(ju),按程序(xu)将涉(she)及性质恶劣、情节(jie)严(yan)重、社(she)会危害较大的(de)(de)(de)违(wei)法(fa)失信(xin)(xin)行(xing)为(wei)的(de)(de)(de)市场主体(ti)(ti)纳入(ru)失信(xin)(xin)联合惩(cheng)戒对(dui)(dui)象(xiang)名(ming)单(dan)。加(jia)快完善相关(guan)管理办法(fa),明确认(ren)定依(yi)据(ju)、标准、程序(xu)、异(yi)议申(shen)诉和退出机制。制定管理办法(fa)要充分征求社(she)会公(gong)(gong)众意见(jian),出台的(de)(de)(de)标准及其具体(ti)(ti)认(ren)定程序(xu)以适当(dang)方(fang)式(shi)向社(she)会公(gong)(gong)开。支(zhi)持有关(guan)部门(men)根据(ju)监管需要建立重点关(guan)注对(dui)(dui)象(xiang)名(ming)单(dan)制度,对(dui)(dui)存在失信(xin)(xin)行(xing)为(wei)但严(yan)重程度尚(shang)未达到失信(xin)(xin)联合惩(cheng)戒对(dui)(dui)象(xiang)认(ren)定标准的(de)(de)(de)市场主体(ti)(ti),可(ke)实(shi)施(shi)与其失信(xin)(xin)程度相对(dui)(dui)应的(de)(de)(de)严(yan)格监管措施(shi)。(各(ge)部门(men)按职责(ze)分别负责(ze))

  (九)督(du)(du)促失(shi)(shi)信(xin)市场(chang)(chang)主体(ti)限期整(zheng)(zheng)(zheng)改。失(shi)(shi)信(xin)市场(chang)(chang)主体(ti)应(ying)当在(zai)规(gui)定(ding)期限内认真整(zheng)(zheng)(zheng)改,整(zheng)(zheng)(zheng)改不(bu)到位的(de),按照“谁认定(ding)、谁约(yue)谈(tan)(tan)”的(de)原则,由认定(ding)部门依(yi)法依(yi)规(gui)启动提示约(yue)谈(tan)(tan)或警示约(yue)谈(tan)(tan)程序,督(du)(du)促失(shi)(shi)信(xin)市场(chang)(chang)主体(ti)履(lv)行相(xiang)关义务、消(xiao)除不(bu)良影响。约(yue)谈(tan)(tan)记(ji)录(lu)记(ji)入失(shi)(shi)信(xin)市场(chang)(chang)主体(ti)信(xin)用(yong)记(ji)录(lu),统一(yi)归集后纳入全国信(xin)用(yong)信(xin)息共享平台。大力推(tui)进重点领域(yu)失(shi)(shi)信(xin)问题专项治理(li),采取有力有效措(cuo)施加快推(tui)进整(zheng)(zheng)(zheng)改。(各部门按职责分别负(fu)责)

  (十)深入开(kai)展失(shi)(shi)(shi)信(xin)(xin)联(lian)合(he)(he)惩(cheng)(cheng)(cheng)戒(jie)(jie)(jie)(jie)。加快构建跨(kua)地区(qu)(qu)、跨(kua)行(xing)(xing)业(ye)、跨(kua)领域的失(shi)(shi)(shi)信(xin)(xin)联(lian)合(he)(he)惩(cheng)(cheng)(cheng)戒(jie)(jie)(jie)(jie)机(ji)制,从根本(ben)上解决失(shi)(shi)(shi)信(xin)(xin)行(xing)(xing)为反复出现、易地出现的问题(ti)。依(yi)法依(yi)规建立联(lian)合(he)(he)惩(cheng)(cheng)(cheng)戒(jie)(jie)(jie)(jie)措(cuo)(cuo)(cuo)(cuo)施清单,动(dong)态更新(xin)并向社(she)会(hui)公(gong)开(kai),形(xing)成行(xing)(xing)政性(xing)(xing)、市场性(xing)(xing)和行(xing)(xing)业(ye)性(xing)(xing)等(deng)惩(cheng)(cheng)(cheng)戒(jie)(jie)(jie)(jie)措(cuo)(cuo)(cuo)(cuo)施多管齐(qi)下,社(she)会(hui)力(li)(li)量广泛参与的失(shi)(shi)(shi)信(xin)(xin)联(lian)合(he)(he)惩(cheng)(cheng)(cheng)戒(jie)(jie)(jie)(jie)大格局(ju)。重点实施惩(cheng)(cheng)(cheng)戒(jie)(jie)(jie)(jie)力(li)(li)度大、监管效果好(hao)的失(shi)(shi)(shi)信(xin)(xin)惩(cheng)(cheng)(cheng)戒(jie)(jie)(jie)(jie)措(cuo)(cuo)(cuo)(cuo)施,包(bao)括依(yi)法依(yi)规限(xian)制失(shi)(shi)(shi)信(xin)(xin)联(lian)合(he)(he)惩(cheng)(cheng)(cheng)戒(jie)(jie)(jie)(jie)对象股票发行(xing)(xing)、招标(biao)投标(biao)、申请财政性(xing)(xing)资金项目、享(xiang)受(shou)税(shui)收优惠等(deng)行(xing)(xing)政性(xing)(xing)惩(cheng)(cheng)(cheng)戒(jie)(jie)(jie)(jie)措(cuo)(cuo)(cuo)(cuo)施,限(xian)制获(huo)得授信(xin)(xin)、乘(cheng)坐飞机(ji)、乘(cheng)坐高等(deng)级列(lie)车和席次等(deng)市场性(xing)(xing)惩(cheng)(cheng)(cheng)戒(jie)(jie)(jie)(jie)措(cuo)(cuo)(cuo)(cuo)施,以及通(tong)报批评、公(gong)开(kai)谴责(ze)等(deng)行(xing)(xing)业(ye)性(xing)(xing)惩(cheng)(cheng)(cheng)戒(jie)(jie)(jie)(jie)措(cuo)(cuo)(cuo)(cuo)施。(发展改(gai)革委牵头(tou),各(ge)地区(qu)(qu)各(ge)部(bu)门按职(zhi)责(ze)分别负责(ze))

  (十一(yi))坚(jian)决(jue)依(yi)法(fa)依(yi)规(gui)实施市(shi)场(chang)和行(xing)(xing)业(ye)禁(jin)入措(cuo)施。以食品药品、生态环境(jing)、工程质量、安全生产(chan)、养(yang)老托幼、城市(shi)运(yun)行(xing)(xing)安全等(deng)与人(ren)民(min)群众生命(ming)财产(chan)安全直(zhi)接相(xiang)关(guan)的(de)领(ling)域为重(zhong)(zhong)点,实施严(yan)格监管,加大惩戒力度。对拒不(bu)履行(xing)(xing)司(si)法(fa)裁(cai)判或行(xing)(xing)政(zheng)处罚决(jue)定(ding)、屡犯(fan)不(bu)改、造成重(zhong)(zhong)大损(sun)失(shi)的(de)市(shi)场(chang)主体及其相(xiang)关(guan)责(ze)任(ren)人(ren),坚(jian)决(jue)依(yi)法(fa)依(yi)规(gui)在一(yi)定(ding)期限内(nei)实施市(shi)场(chang)和行(xing)(xing)业(ye)禁(jin)入措(cuo)施,直(zhi)至(zhi)永远逐出市(shi)场(chang)。(发展改革(ge)委牵头,各(ge)地(di)区各(ge)部(bu)门按职责(ze)分别负责(ze))

  (十二)依法(fa)追(zhui)究(jiu)违(wei)法(fa)失(shi)信责(ze)任(ren)。建立健全责(ze)任(ren)追(zhui)究(jiu)机(ji)制(zhi),对(dui)(dui)被列入失(shi)信联(lian)合(he)惩戒(jie)对(dui)(dui)象名单的市场主(zhu)(zhu)体,依法(fa)依规对(dui)(dui)其法(fa)定代表人(ren)或主(zhu)(zhu)要负责(ze)人(ren)、实际控制(zhi)人(ren)进(jin)行失(shi)信惩戒(jie),并将相(xiang)关(guan)失(shi)信行为(wei)记(ji)(ji)入其个人(ren)信用记(ji)(ji)录。机(ji)关(guan)事业(ye)单位、国有企(qi)业(ye)出(chu)现(xian)违(wei)法(fa)失(shi)信行为(wei)的,要通(tong)报(bao)上级(ji)主(zhu)(zhu)管单位和(he)审计部(bu)门(men);工作人(ren)员出(chu)现(xian)违(wei)法(fa)失(shi)信行为(wei)的,要通(tong)报(bao)所在单位及相(xiang)关(guan)纪检监察、组织人(ren)事部(bu)门(men)。(各(ge)地(di)区(qu)各(ge)部(bu)门(men)按职责(ze)分(fen)别负责(ze))

  (十三)探索(suo)建立信(xin)(xin)(xin)用(yong)(yong)(yong)修复(fu)机制。失(shi)(shi)(shi)信(xin)(xin)(xin)市(shi)场(chang)主(zhu)体在规定期限内纠正失(shi)(shi)(shi)信(xin)(xin)(xin)行为(wei)(wei)、消(xiao)除不(bu)良影(ying)响(xiang)的,可通过作出信(xin)(xin)(xin)用(yong)(yong)(yong)承诺、完成(cheng)信(xin)(xin)(xin)用(yong)(yong)(yong)整改、通过信(xin)(xin)(xin)用(yong)(yong)(yong)核(he)查、接受(shou)专题培(pei)训、提交(jiao)信(xin)(xin)(xin)用(yong)(yong)(yong)报(bao)告、参加公益慈善活动(dong)等方式(shi)开展(zhan)(zhan)信(xin)(xin)(xin)用(yong)(yong)(yong)修复(fu)。修复(fu)完成(cheng)后,各(ge)(ge)地区各(ge)(ge)部门(men)要按(an)(an)程(cheng)序(xu)及时停止(zhi)公示其失(shi)(shi)(shi)信(xin)(xin)(xin)记(ji)录,终止(zhi)实施(shi)联合惩戒措(cuo)施(shi)。加快建立完善协同(tong)联动(dong)、一网通办(ban)机制,为(wei)(wei)失(shi)(shi)(shi)信(xin)(xin)(xin)市(shi)场(chang)主(zhu)体提供(gong)高效便(bian)捷的信(xin)(xin)(xin)用(yong)(yong)(yong)修复(fu)服(fu)(fu)务(wu)(wu)。鼓(gu)励符(fu)合条件(jian)的第(di)三方信(xin)(xin)(xin)用(yong)(yong)(yong)服(fu)(fu)务(wu)(wu)机构(gou)向失(shi)(shi)(shi)信(xin)(xin)(xin)市(shi)场(chang)主(zhu)体提供(gong)信(xin)(xin)(xin)用(yong)(yong)(yong)报(bao)告、信(xin)(xin)(xin)用(yong)(yong)(yong)管理咨询等服(fu)(fu)务(wu)(wu)。(发展(zhan)(zhan)改革委牵头,各(ge)(ge)地区各(ge)(ge)部门(men)按(an)(an)职责(ze)(ze)分别(bie)负责(ze)(ze))

  五、强化信用监管的支撑保障

  (十五)大力推进信(xin)(xin)用监管(guan)信(xin)(xin)息(xi)公(gong)开(kai)(kai)公(gong)示(shi)(shi)。在行(xing)(xing)(xing)政(zheng)(zheng)(zheng)(zheng)(zheng)许可、行(xing)(xing)(xing)政(zheng)(zheng)(zheng)(zheng)(zheng)处(chu)罚信(xin)(xin)息(xi)集(ji)中(zhong)公(gong)示(shi)(shi)基础上,依(yi)托“信(xin)(xin)用中(zhong)国(guo)”网(wang)站、中(zhong)国(guo)政(zheng)(zheng)(zheng)(zheng)(zheng)府网(wang)或其(qi)他(ta)渠道(dao),进一(yi)步研(yan)究推动行(xing)(xing)(xing)政(zheng)(zheng)(zheng)(zheng)(zheng)强(qiang)制、行(xing)(xing)(xing)政(zheng)(zheng)(zheng)(zheng)(zheng)确认、行(xing)(xing)(xing)政(zheng)(zheng)(zheng)(zheng)(zheng)征收、行(xing)(xing)(xing)政(zheng)(zheng)(zheng)(zheng)(zheng)给付、行(xing)(xing)(xing)政(zheng)(zheng)(zheng)(zheng)(zheng)裁决、行(xing)(xing)(xing)政(zheng)(zheng)(zheng)(zheng)(zheng)补偿、行(xing)(xing)(xing)政(zheng)(zheng)(zheng)(zheng)(zheng)奖励和(he)行(xing)(xing)(xing)政(zheng)(zheng)(zheng)(zheng)(zheng)监督检(jian)查等(deng)其(qi)他(ta)行(xing)(xing)(xing)政(zheng)(zheng)(zheng)(zheng)(zheng)行(xing)(xing)(xing)为信(xin)(xin)息(xi)7个工作日(ri)内上网(wang)公(gong)开(kai)(kai),推动在司法裁判和(he)执(zhi)行(xing)(xing)(xing)活(huo)动中(zhong)应(ying)当公(gong)开(kai)(kai)的失(shi)信(xin)(xin)被执(zhi)行(xing)(xing)(xing)人(ren)、虚假诉讼失(shi)信(xin)(xin)人(ren)相关(guan)信(xin)(xin)息(xi)通过适当渠道(dao)公(gong)开(kai)(kai),做到“应(ying)公(gong)开(kai)(kai)、尽公(gong)开(kai)(kai)”。(各地区各部门按职责分别负责)

  (十六(liu))充分发挥“互联(lian)网(wang)(wang)+”、大数(shu)据(ju)对(dui)(dui)信(xin)(xin)用(yong)(yong)(yong)监(jian)(jian)管(guan)的(de)(de)支撑作用(yong)(yong)(yong)。依(yi)托国家(jia)“互联(lian)网(wang)(wang)+监(jian)(jian)管(guan)”等(deng)(deng)系统(tong),有效(xiao)整合公(gong)共信(xin)(xin)用(yong)(yong)(yong)信(xin)(xin)息(xi)、市(shi)场(chang)信(xin)(xin)用(yong)(yong)(yong)信(xin)(xin)息(xi)、投(tou)诉(su)举报信(xin)(xin)息(xi)和(he)互联(lian)网(wang)(wang)及(ji)第三(san)方相关信(xin)(xin)息(xi),充分运用(yong)(yong)(yong)大数(shu)据(ju)、人工(gong)智能等(deng)(deng)新(xin)一代信(xin)(xin)息(xi)技术(shu),实现(xian)(xian)信(xin)(xin)用(yong)(yong)(yong)监(jian)(jian)管(guan)数(shu)据(ju)可比对(dui)(dui)、过(guo)程(cheng)可追(zhui)溯、问(wen)题可监(jian)(jian)测。鼓励各地(di)区各部门结合实际,依(yi)法依(yi)规(gui)(gui)与大数(shu)据(ju)机构合作开(kai)发信(xin)(xin)用(yong)(yong)(yong)信(xin)(xin)息(xi),及(ji)时(shi)动(dong)(dong)态掌(zhang)握市(shi)场(chang)主体经营(ying)情况及(ji)其规(gui)(gui)律特征(zheng)。充分利用(yong)(yong)(yong)国家(jia)“互联(lian)网(wang)(wang)+监(jian)(jian)管(guan)”等(deng)(deng)系统(tong)建立风险(xian)(xian)预(yu)判预(yu)警机制,及(ji)早发现(xian)(xian)防范(fan)苗头性和(he)跨行(xing)业跨区域(yu)风险(xian)(xian)。运用(yong)(yong)(yong)大数(shu)据(ju)主动(dong)(dong)发现(xian)(xian)和(he)识别违法违规(gui)(gui)线索(suo),有效(xiao)防范(fan)危害公(gong)共利益和(he)群众生命(ming)财(cai)产安全的(de)(de)违法违规(gui)(gui)行(xing)为。鼓励通过(guo)物联(lian)网(wang)(wang)、视(shi)联(lian)网(wang)(wang)等(deng)(deng)非(fei)接(jie)触式监(jian)(jian)管(guan)方式提升执(zhi)法监(jian)(jian)管(guan)效(xiao)率,实现(xian)(xian)监(jian)(jian)管(guan)规(gui)(gui)范(fan)化(hua)、精准化(hua)、智能化(hua),减(jian)少人为因素,实现(xian)(xian)公(gong)正监(jian)(jian)管(guan),杜绝随意检查、多(duo)头监(jian)(jian)管(guan)等(deng)(deng)问(wen)题,实现(xian)(xian)“进一次(ci)门、查多(duo)项事”,减(jian)少对(dui)(dui)监(jian)(jian)管(guan)对(dui)(dui)象的(de)(de)扰动(dong)(dong)。(国务院办公(gong)厅、发展改革委(wei)、市(shi)场(chang)监(jian)(jian)管(guan)总局牵头,各部门按职责分别负责)

  (十(shi)七(qi))切实加(jia)大(da)信(xin)(xin)(xin)(xin)(xin)用信(xin)(xin)(xin)(xin)(xin)息安(an)全和(he)市(shi)场主(zhu)体(ti)(ti)权(quan)益保护(hu)力度(du)。严肃(su)查(cha)处(chu)违规泄露(lu)、篡改(gai)信(xin)(xin)(xin)(xin)(xin)用信(xin)(xin)(xin)(xin)(xin)息或利用信(xin)(xin)(xin)(xin)(xin)用信(xin)(xin)(xin)(xin)(xin)息谋私等行(xing)为。加(jia)强信(xin)(xin)(xin)(xin)(xin)用信(xin)(xin)(xin)(xin)(xin)息安(an)全基础(chu)设(she)施(shi)和(he)安(an)全防护(hu)能力建(jian)设(she)。建(jian)立健(jian)全信(xin)(xin)(xin)(xin)(xin)用信(xin)(xin)(xin)(xin)(xin)息异议投(tou)诉制(zhi)度(du),对(dui)市(shi)场主(zhu)体(ti)(ti)提(ti)出异议的信(xin)(xin)(xin)(xin)(xin)息,信(xin)(xin)(xin)(xin)(xin)息提(ti)供和(he)采(cai)(cai)集单(dan)位要尽快核实并反馈(kui)结果,经核实有误(wu)的信(xin)(xin)(xin)(xin)(xin)息要及时予以更(geng)正或撤(che)销。因错误(wu)认定失信(xin)(xin)(xin)(xin)(xin)联(lian)合惩戒对(dui)象名单(dan)、错误(wu)采(cai)(cai)取失信(xin)(xin)(xin)(xin)(xin)联(lian)合惩戒措(cuo)施(shi)损害市(shi)场主(zhu)体(ti)(ti)合法(fa)权(quan)益的,有关部门和(he)单(dan)位要积极采(cai)(cai)取措(cuo)施(shi)消除不(bu)良影响。(各地区(qu)各部门按职责分别负责)

  (十(shi)八(ba))积极引(yin)导(dao)行(xing)业(ye)(ye)组织和(he)信(xin)(xin)(xin)(xin)用(yong)(yong)(yong)(yong)(yong)服务机构协同监(jian)管(guan)。支持有关部门(men)授权的行(xing)业(ye)(ye)协会商(shang)会协助开展(zhan)(zhan)行(xing)业(ye)(ye)信(xin)(xin)(xin)(xin)用(yong)(yong)(yong)(yong)(yong)建设和(he)信(xin)(xin)(xin)(xin)用(yong)(yong)(yong)(yong)(yong)监(jian)管(guan),鼓(gu)励(li)(li)行(xing)业(ye)(ye)协会商(shang)会建立会员信(xin)(xin)(xin)(xin)用(yong)(yong)(yong)(yong)(yong)记录,开展(zhan)(zhan)信(xin)(xin)(xin)(xin)用(yong)(yong)(yong)(yong)(yong)承诺、信(xin)(xin)(xin)(xin)用(yong)(yong)(yong)(yong)(yong)培训(xun)、诚信(xin)(xin)(xin)(xin)宣传、诚信(xin)(xin)(xin)(xin)倡议等(deng)(deng),将诚信(xin)(xin)(xin)(xin)作(zuo)(zuo)为(wei)行(xing)规行(xing)约重要内(nei)容,引(yin)导(dao)本行(xing)业(ye)(ye)增(zeng)强(qiang)依法诚信(xin)(xin)(xin)(xin)经营(ying)意识。推动征信(xin)(xin)(xin)(xin)、信(xin)(xin)(xin)(xin)用(yong)(yong)(yong)(yong)(yong)评级、信(xin)(xin)(xin)(xin)用(yong)(yong)(yong)(yong)(yong)保险、信(xin)(xin)(xin)(xin)用(yong)(yong)(yong)(yong)(yong)担保、履(lv)约担保、信(xin)(xin)(xin)(xin)用(yong)(yong)(yong)(yong)(yong)管(guan)理咨询(xun)及培训(xun)等(deng)(deng)信(xin)(xin)(xin)(xin)用(yong)(yong)(yong)(yong)(yong)服务发展(zhan)(zhan),切实发挥第三方信(xin)(xin)(xin)(xin)用(yong)(yong)(yong)(yong)(yong)服务机构在信(xin)(xin)(xin)(xin)用(yong)(yong)(yong)(yong)(yong)信(xin)(xin)(xin)(xin)息采集、加工、应用(yong)(yong)(yong)(yong)(yong)等(deng)(deng)方面(mian)的专业(ye)(ye)作(zuo)(zuo)用(yong)(yong)(yong)(yong)(yong)。鼓(gu)励(li)(li)相关部门(men)与第三方信(xin)(xin)(xin)(xin)用(yong)(yong)(yong)(yong)(yong)服务机构在信(xin)(xin)(xin)(xin)用(yong)(yong)(yong)(yong)(yong)记录归(gui)集、信(xin)(xin)(xin)(xin)用(yong)(yong)(yong)(yong)(yong)信(xin)(xin)(xin)(xin)息共(gong)享(xiang)、信(xin)(xin)(xin)(xin)用(yong)(yong)(yong)(yong)(yong)大(da)数据分析、信(xin)(xin)(xin)(xin)用(yong)(yong)(yong)(yong)(yong)风险预警、失(shi)信(xin)(xin)(xin)(xin)案例核查(cha)、失(shi)信(xin)(xin)(xin)(xin)行(xing)为(wei)跟踪监(jian)测等(deng)(deng)方面(mian)开展(zhan)(zhan)合(he)作(zuo)(zuo)。(发展(zhan)(zhan)改革委、民政部、人(ren)民银行(xing)按职责(ze)分别负责(ze))

  六、加强信用监管的(de)组织实施

  (十九)加(jia)(jia)强组(zu)织领(ling)导。各(ge)地(di)区(qu)各(ge)部(bu)门要(yao)把构(gou)建以信(xin)用(yong)(yong)(yong)(yong)为(wei)(wei)基础的(de)(de)(de)新型监管(guan)机(ji)制作为(wei)(wei)深(shen)入(ru)推(tui)进“放(fang)管(guan)服”改(gai)革的(de)(de)(de)重要(yao)举(ju)措,摆在更加(jia)(jia)突出(chu)的(de)(de)(de)位(wei)置,加(jia)(jia)强组(zu)织领(ling)导,细(xi)化责(ze)任分工,有(you)力(li)有(you)序有(you)效推(tui)动落实。完善信(xin)用(yong)(yong)(yong)(yong)监管(guan)的(de)(de)(de)配套制度,并加(jia)(jia)强与(yu)(yu)其他“放(fang)管(guan)服”改(gai)革事项的(de)(de)(de)衔(xian)接。负(fu)有(you)市场(chang)监管(guan)、行业监管(guan)职责(ze)的(de)(de)(de)部(bu)门要(yao)切实承(cheng)担行业信(xin)用(yong)(yong)(yong)(yong)建设和信(xin)用(yong)(yong)(yong)(yong)监管(guan)的(de)(de)(de)主体责(ze)任,充(chong)分发挥(hui)行业组(zu)织、第三方(fang)信(xin)用(yong)(yong)(yong)(yong)服务机(ji)构(gou)作用(yong)(yong)(yong)(yong),为(wei)(wei)公众监督创造(zao)有(you)利条件,整合形成(cheng)全社(she)会(hui)共同参(can)与(yu)(yu)信(xin)用(yong)(yong)(yong)(yong)监管(guan)的(de)(de)(de)强大合力(li)。(发展改(gai)革委牵头,各(ge)地(di)区(qu)各(ge)部(bu)门按职责(ze)分别负(fu)责(ze))

  (二十一)加快(kuai)建章(zhang)立制。推动制定(ding)社会(hui)信(xin)用(yong)(yong)体系建设(she)相关(guan)法(fa)(fa)律,加快(kuai)研究(jiu)出(chu)台公共信(xin)用(yong)(yong)信(xin)息管(guan)理条例(li)、统一社会(hui)信(xin)用(yong)(yong)代码管(guan)理办法(fa)(fa)等(deng)法(fa)(fa)规(gui)(gui)。建立健全全国统一的信(xin)用(yong)(yong)监管(guan)规(gui)(gui)则和(he)标(biao)(biao)准(zhun),及时出(chu)台相关(guan)地方(fang)性(xing)法(fa)(fa)规(gui)(gui)、政府(fu)规(gui)(gui)章(zhang)或(huo)规(gui)(gui)范性(xing)文件,将信(xin)用(yong)(yong)监管(guan)中行之(zhi)有效的做法(fa)(fa)上升(sheng)为制度(du)规(gui)(gui)范。抓紧制定(ding)开展信(xin)用(yong)(yong)监管(guan)急需的国家标(biao)(biao)准(zhun)。(发展改革委(wei)、司法(fa)(fa)部牵头,各地区各部门按职责分(fen)别负责)
